Hedge cutting - 2006/05/04 10:19
I have a well maintained (ie trimmed every August or September)14 foot hedge at the bottom of my garden which my neighbours wish me to reduce it to 7 foot. The hedge is not a boundary hedge and it's clearly on my land. A new law implemented last year in Wales - the Anti Social Behaviour Act (2003) - enables my neighbours to take a complaint to the local council who have the power to insist that the hedge be reduced. However, I have nesting birds in the hedge and these are protected under the Countryside and Wildlife Act 1981 later strengthened in 200?. It seems there is a conflict between the two laws. Has anyone come across this problem or does anyone know which of the two laws takes precedence? Where is the duty and where is the power in these laws? What would be the position if birds nest in the hedge all the year round? We are not wildlife or bird experts so how can we determine exactly what birds are nesting there?
